How much is the filing fee?

The basic filing fee for an uncontested divorce action is $280 (RCW 36.18.020).  However many counties add additional fees to fund their programs, making the filing fee higher.  The average filing fee for a divorce or legal separation in Washington State is $280.  You should contact your County Clerk for the exact amount of the filing fee for a Petition for Dissolution of Marriage or Legal Separation.

Please note the filing fee is NOT included in the cost of your form preparation.  This is a separate fee you must submit to the Clerk yourself.  Payment by money order or cashier's check is recommended.

My spouse won't sign the documents.

Then you will need to have the Summons and Petition for Dissolution of Marriage or Legal Separation served on your spouse by an independent third party (not you).  Your County Sheriff or a process server can perform this service for you.  Be sure to add a Summons to your cart at checkout.

If you choose to have a friend serve your spouse, they will need to complete and sign a Declaration of Service, and you will need to file the original document with the court clerk.  If you chose this method, be sure to include the Declaration of Service package in your cart at checkout.

Want minimal court involvement in your divorce?

Many couples want to make their own decisions regarding the division of their property and debts in their uncontested divorce or legal separation with minimal court involvement.  Or prefer not to have their private information be public record.

Unless you indicate otherwise on the Questionnaire, we will prepare your documents for filing, by mail, in Lincoln County, Washington.  No court appearance is required by Lincoln County. 

Lincoln county does not require attendance at the parenting seminar, if you have children.

I can't locate my spouse - can I still get divorced?

If you do not know where your spouse lives, you can still obtain a divorce by giving your missing spouse notice by publication in a newspaper in the county in which you file your divorce.  RCW 4.28.100  This process is more expensive because of the publication costs (approx. $300 and up depending on the newspaper.), and the additional motion and order filed with the court.

The Summons must be published for six consecutive weeks.  RCW 4.28.110
