DIVIDING PROPERTY AND BILLS

For any item of property or debts that you do not list for division in the divorce, you will retain joint ownership with your spouse.

You cannot ask for more in the Decree of Dissolution than you did in the Petition.

In the Petition for Dissolution of Marriage or Legal Separation, you will state which spouse should be awarded which property and debts.  This information will be repeated in the Decree of Dissolution or Decree of Legal Separation. 

Part of the divorce process is the division of your property and debts that either party acquired before the marriage (separate) or during the marriage (community).


Separate property can also be acquired during marriage such as a gift or inheritance. 

When completing the Questionnaire, property and debts need to be identifiable:

You should at least provide an address for each parcel of real property.

bullet

For each vehicle, include the year, make and model.

bullet

When you describe a business, provide the name and type of ownership (i.e. single owner, partnership, etc.)

bullet

Provide the type and name of your pet.  (i.e. cat named "Smokey" or Golden Retriever dog.)

bullet

For each debt, you should provide the name of the creditor and amount owed.  If you have duplicate obligations to the same creditor, list the last four digits of the account number to identify the account or debt.
