CHILD SUPPORT

Child support can either be (1) the standard monthly amount pursuant to calculations on the Child Support Schedule (based on your incomes) or (2) a deviation from the standard amount, which is an amount you and your spouse will agree upon.  An agreed amount can be higher or lower than the standard amount.  Minimum child support is $25.  If no income information is provided, child support is calculated using the imputed income table.  You and your spouse will need to agree:

How much is to be paid each month?

Date of monthly payment?

bullet

Which parent will receive the child support payments?

bullet

Do you want payments made directly to that parent?

bullet

Or, do you want you the payments made to the Division of Child Support and then forwarded to you?

bullet

Or, do you want the Division of Child Support to provide full collection and payment services?

bullet

Do you want the other parent to pay by wage assignment, where the child support is taken directly from their paycheck by their employer?

 

SUPPORT FOR YOUR DEPENDENT CHILDREN
(Child Support)

Preparation of your Order of Child Support will include information regarding calculation of child support based on the income of both parents, and payment methods. 


If the amount of child support you agree on is more or less than the amount calculated pursuant to the Child Support Guidelines, a deviation of child support will be included in your Order of Child Support.  The court has the sole discretion to approve or disapprove a request for deviation from the standard child support calculation.

 

HEALTH INSURANCE

The Order of Child Support also sets forth which parent (or both) will provide health insurance for your children.  Items to consider would be:

Does your employer provide healthcare insurance for your children?

bullet

Does your spouse's employer provide healthcare insurance for your children?

bullet

If your employers do not provide healthcare insurance for your children, which parent will provide healthcare insurance?
